Notice on the Management of Construction Projects for the Production and Use of Ozone-depleting Substances

The Environmental Protection Bureau (EPA) of the provinces, autonomous regions and municipalities directly under the Central Government and the Environmental Protection Bureau of the Xinjiang Production and Construction Corps: 

 

According to the “Montreal Protocol on Substances that Deplete the Ozone Layer” (hereinafter referred to as “the Protocol”) and its relevant amendments, which our government has ratified and acceded to. Besides special uses, China has eliminated the production and use of controlled ozone-depleting substances such as halons, perchlorofluorocarbons, carbon tetrachloride, methyl chloroform and methyl bromide, and is gradually reducing the production and use of hydrogen-containing chlorine for controlled uses. In order to achieve the implementation objectives set out in the Protocol, and in accordance with the relevant provisions of the “Regulations on the Management of Substances that Deplete the Ozone Layer”, the relevant requirements are now notified as follows:

 

1. It is prohibited to build, expand, produce and use ozone-depleting substances for controlled uses such as refrigerants, foaming agents, fire extinguishers, solvents, cleaning agents, processing aids, aerosols and soil fumigants. 

 

2. Reconstruction and off-site construction projects to produce controlled ozone-depleting substances shall be prohibited from increasing the production capacity of ozone-depleting substances. 

 

3. Construction projects for new construction, renovation and expansion of ozone-depleting substances for the production of chemical raw materials shall be built. The ozone-depleting substances produced shall be used only for the purpose of special raw materials for downstream chemical products of enterprises themselves and shall not be sold in the market. 

 

4. Construction projects for new construction, reconstruction and expansion of by-product carbon tetrachloride shall be supported by the construction of facilities for the disposal of carbon tetrachloride. 

 

5. The ozone-depleting substances are specified in the “List of Controlled Ozone-depleting Substances in China” (Announcement No. 72 of 2010 issued by the Ministry of Environmental Protection, the Development and Reform Commission and the Ministry of Industry and Information Technology). 

 

6. This Notice shall come into effect from the date of issuance. Former “Notice on Prohibiting New Production and Use of Production Facilities for Ozone-depleting Substances” (EDF [1997] 733), “Supplementary Notice on the Notice on Prohibiting New Production and Use of Production Facilities for Ozone-depleting Substances” (EDF [1999] 147), “Notice on Strict Control of New (Expanded) Construction of Production Projects for Carbon Tetrachloride” (UNOED [2003] 28), “Notice on Strict Control of Projects for the Production of 1,1,1-trichloroethane and Methyl Bromide” (UNOECD No. 60), “Notice on Prohibition of the New Use of Ozone-depleting Substances as Processing Aids” (pro-environment Letter No. [2004] 410), “Supplementary Notice on Strict Control of the Use of Carbon Tetrachloride in New (Expansion) Projects” (UNOECD No. [2006] 15), "Notice on Strict Control of New, Reconstructed and Extended Hydrochlorofluorocarbons Production Projects" (UNOED [2008] 104), "Notice on Strict Control of New Hydrochlorofluorocarbons Production Facilities" (UNOED [2009] 121), "Supplementary Notice on Strict Control of New, Reconstructed and Extended Hydrochlorofluorocarbons Production Projects" (UNOED Letter No. [2015] 644) abolished at the same time.
