Bidding Announcement on the Study on the Regulatory, Enforcement, Policy and Market Circumstances of ODS Phase-out in China

The Montreal Protocol on Substances that Deplete the Ozone Layer, signed on 16th September 1987 by the international community, protects the ozone layer by phasing out the consumption and the production of ozone-depleting substances. With collaborative efforts of the parties, nearly 99% of production and consumption of ODs have been phased out since its inception, meeting the objectives of the Protocol successfully.

 

Since its ratification of the Montreal Protocol in 1991, the Government of China has been pushing forward the substitution of the ozone-depleting substances as a party operating under Article 5. The institutional mechanisms, policy and enforcement system for the implementation of the Montreal protocol is established and improved step by step. The adoption of sector phase-out approach approves to be effective. About 280,000 MT of controlled substances have been phased out in total, accounting for over half of all ODS phased out by developing parties. In addition, China has met the targets specified in HCFCs Phase-out Management Plans Stage I in advance.

 

With the phase-out of controlled uses of five main categories of ODS, China is currently phasing out the production and consumption of HCFCs in relevant sectors. In order to ensure the sustainable compliance with the Protocol and implementation of phase-out activities at next stage as planned, it is scheduled to engage a non-governmental consulting agency to make a study on the regulatory, policy, enforcement and market circumstances of ODS phase-out in China with case studies based on quantitative data and qualitative market information, to assess the efficacy of the regulatory and policy framework on ODS management, analyze current and historical market data and corresponding management challenges.

 

I. Scope of Work

 

i. Analysis of the regulatory and policy framework of ODS management in China

 

1. Life-cycle control, such as production, sales, use, import, export, recycle and disposal and corresponding requirements and management mechanism, such as total amount control and quota management, licensing system, registration system, etc.;

 

2. Stipulations on legal obligations of different stakeholders, reporting, monitoring and inspection, penalties, and Legal obligations, reporting, supervision, inspection, and penalties by relevant parties;

 

3. The relationships between the state, provincial, city and county levels with regard to formulation and execution of these policies and rules to assess the functions of the regulatory and legal system in China’s compliance with the Montreal Protocol;

 

ii Assessment on the degree of efficacy of current supervision and management system

 

1. Operation model and law enforcement inspection means of ODS supervision and management system;

 

2. Case information of illegal production and use, including the identification of such cases and ultimate penalties;

 

3. Determine whether punitive measures, including those under the ODS regulations are sufficient to deter illegal production, sales and consumption of banned ODS by modeling the cost impact, potential incentives of illegal activities and the provisions invoked;

 

iii. Analysis of quantitative data and qualitative circumstances of ODS market

 

1. Current market assessment, including:

 

(1)Demand assessment: The non-government consulting organization will determine whether there are any uses of banned controlled substances in the foam, refrigeration and other Montreal Protocol sectors by conducting a mass balance analysis per MP sector between raw materials (including HCFC blowing agent, non-ODS blowing agents/refrigerants, polyol/compressors, and other components/raw materials as relevant) used for manufacturing and servicing with the market demand for HCFCs and their alternatives;

 

(2)Supply assessment: production of HCFCs compared to demand, leakage potential to the market of HCFCs destined for feedstock use, production costs of HCFCs, and market price of HCFCs and its alternatives;

 

(3)HCFC-22 production facilities, including production capacity, actual production, consumption of raw materials, on-stream period, machine operation records to evaluate the operation of these facilities, including idle and integrated facilities;

 

(4)CTC market information, including production at CMS facilities and at PCE facilities, the by-product amount, feedstock use amount, converted amount, sales and distribution models to examine the conformity between the production, generation and demand of CTC;

 

(5)Trend analysis of relevant sectors to look at the sustainability in the future whether there is or is not illegal production and use.

 

2. Development of an inventory of CFC-11 and CFC-12 stockpiles and banks since the mid-1990s and assessment of this historical data, including production and consumption amount, product amount, product types, application areas, product life cycle, geographical distribution of end-users, leakage rates and amounts, treatment of retired products to determine emission pathways of CFC-11 and CFC-12 banks.

 

iv. Summary of characteristics of the regulatory, enforcement, policy and market circumstances including weakness, based on the above study, put forward suggestions on addressing challenges on ODS management and improvement of the regulatory, enforcement and policy systems to ensure sustainable implementation of the Protocol.

 

v Organize or facilitate at least three meetings participated by the Ministry of Ecology and Environment, relevant ministries, industry associations, enterprises, industry experts etc., to ensure the authenticity and credibility of data, methodologies adopted and findings in the final study report.

 

vi The consulting agency may participate in relevant survey and meetings organized by stakeholders that may contributed to the study.

 

II. Outputs

 

i. Inception report, including project methodology, timeline and planned consultations/meetings;

 

ii. Draft study report on the regulatory, enforcement, policy and market circumstances of ODS management system in China;

 

iii. Final study report on the regulatory, enforcement, policy and market circumstances of ODS management system in China;

 

iv. Meeting minutes.

 

III. Schedule

 

The project will be implemented from November 2019 to August 2020. The detailed schedule is as follows:

 

November 2019, preparation of inception report;

 

November 2019 to January 2020, completion of data and information collection, analysis of the regulatory, policy, enforcement and market circumstances, preparation of the outline of the report, and the first meeting for discussion;

 

February to March 2020, completion of first draft of the report, the second meeting for discussion on the draft report;

 

April to August 2020, revision to the first draft of the report, the third meeting for discussion on the revised version of the draft report;

 

August 2020, completion of the final report of the report.

 

IV. Qualification of Bidders

 

The qualification requirements of the consulting agency are:

 

i. Legal organization with independent legal person status registered in China;

 

ii. A minimum of five years of experience in providing environment policy consultancy to governments, multilateral or international organizations (copies of the first page, pages of contract amount and seals shall be provided);

 

iii. Be familiar with ODS phase-out and the regulatory, policy enforcement systems of China and other major parties to the Montreal Protocol, especially parties operating under Article 5;

 

iv. Be familiar with private sectors, in particular the market and supply chain of chemical products, and sectors of the Montreal Protocol (production and consumption of ODS in foam, refrigeration, solvents);

 

Team leader shall meet the following qualification requirements:

 

i. The team leader shall hold a master’s degree or above in environmental management or science & technology (relevant certificates shall be provided);

 

ii. Be familiar with the history, institutions and implementation of Montreal Protocol and Multilateral Fund, especially major ODS production and consumption countries and Parties operating under Article 5; comprehensive knowledge and understanding of ODS sectors, ODS phase-out process, ODS management regulations and rules, and the related regulatory, enforcement, policy systems in China at central and local levels;

 

iii. A minimum of five years of experience in providing environment policy consultancy to industry, governments, multilateral or international organizations as team leader in the field (names of the project, the competent authorities/organizations of the project and the positions taken shall be listed);

 

iv. Excellent writing and speaking skills in English.

 

Qualifications of the team members:

 

i. At least two people holding master’s degrees in relevant area (certificates needed);

 

ii. At least three years’ working experiences in relevant fields (economics, data collection and management, chemistry/ process engineering and environmental policies, please specify the project name, competent authorities and the roles).

VII. Notes

 

Packaging requirements: the package of the whole project proposal should consist of an outer sealing bag and two inner sealing bags. The name of the project, unit, communication address, contact person and the telephone number should be indicated on the outer sealing bag. The "technical proposal" and "financial proposal" should be marked separately in the two inner sealing bags. The outer and inner sealing bags should be sealed well and sealed with the official stamp of the unit.

 

Requirements of personnel CV: the personnel as listed in the project proposals shall submit their personnel information and sign their names according to the format set forth I the bidding documents. Please see the format of CVs thereafter. Resume Requirements: Personnel listed in the project proposal should submit relevant personal information in accordance with the format listed in the bidding documents and be confirmed by their signatures. See attached the resume format requirements.

 

Technical proposal requirements: please compile your technical proposal, and elaborate on the research technology route, technical method and work plan to be adopted specifically, referring to the requirements of the ToR. This part is an important assessment factor in the bid evaluation process. If the above-mentioned substantive elaboration is not made based on the content of ToR, the technical proposal will be regarded as not responding to the requirements of the bidding documents and will not be accepted by FECO.

 

Units interested in bidding are requested to compile bidding documents in compliance with the “Law of the People's Republic of China on Tendering and Bidding” and the relevant requirements of project managers.
